This Productized Production Agreement (“Agreement”) is entered into by and between Gear Seven Creative, LLC d/b/a Placemat Studio (“Producer”) and the purchasing client (“Client”). By purchasing a Placemat Studio package, Client agrees to the terms set forth below.
Producer agrees to capture tabletop product video and/or still imagery of Client-supplied products in accordance with the package and any add-ons selected by Client at time of purchase (“Package”).
Client acknowledges that Placemat Studio operates on a batch-based monthly production schedule, and that production timing, creative execution, and delivery timelines are structured accordingly.
Services are limited strictly to the deliverables included in the purchased Package. Packages are based on single clips and may not include edited videos, color corrected videos or music based on the package purchased. Add-ons may be purchased separately.
All fees are due in full at the time of booking. Production will not commence until payment is received.
All payments are non-refundable, except as expressly provided in Section 6 (Limited Rescheduling).
Ownership of deliverables does not transfer until full payment has been received.
Client is solely responsible for shipping all products to Producer and for all associated shipping costs.
Client must provide valid shipment tracking numbers via the Placemat Studio intake form immediately upon shipment.
Client must provide a return shipping label if any products must be returned. Producer cannot guarantee that products will be in their original packaging , condition, or unaltered based on Producers need to capture product creatively as provided in Section 4 (Product Handeling & Risk of Loss).
All products must be received by Producer no later than three (3) business days prior to the scheduled production date.
Failure to meet this deadline may result in removal from the scheduled production batch and forfeiture of the booking without refund.
Producer is not responsible for carrier delays, lost shipments, or incomplete deliveries.
Client acknowledges that products may be opened, handled, poured, cut, unsealed, or otherwise altered as reasonably required to capture the deliverables.
While Producer will exercise reasonable care, Client assumes all risk of loss, damage, spoilage, melting, leakage, or breakage of products during handling or production.
Producer is not responsible for replacing Client products.
Producer retains full creative discretion over composition, lighting, camera movement, styling, and execution, within the general aesthetic selected by Client.
Reshoots are not included in any Placemat Studio package and will not be provided at no cost.
Requests for reshoots require a new booking and full payment for an additional production slot. Dissatisfaction based on subjective preference does not constitute grounds for a reshoot or refund.
Client may request one (1) reschedule to a future production date if:
Reschedule requests must be submitted no later than two (2) business days prior to the scheduled production date.
Rescheduling is subject to availability and must occur within sixty (60) days of the original production date.
After one reschedule, the booking is forfeited and no refund will be issued.
Upon full payment, all deliverables shall be considered a “work made for hire” and owned by Client in perpetuity.
Client grants Producer the perpetual, worldwide right to use deliverables for portfolio, promotional, website, and social media purposes.
Raw footage and unedited files are not included unless explicitly stated in the purchased Package.
Producer will retain final deliverable files as referenced in Section 1 (“Package”) for up to thirty (30) days following delivery, after which they may be deleted at Producer’s discretion.

10. LIMITATION OF LIABILITY
Producer’s total liability under this Agreement shall not exceed the total amount paid by Client for the purchased Package.
In no event shall Producer be liable for any indirect, incidental, or consequential damages.
This Agreement shall be governed by and construed in accordance with the laws of the State of Tennessee.
By purchasing a Placemat Studio package, Client acknowledges that they have read, understood, and agreed to this Agreement.
